An Illinois licensee who represents you must disclose to you the material facts concerning the transaction that the licensee actually knows, unless the information is confidential information. A licensee who does not represent you owes you something narrower. If the licensee works for the seller, the Real Estate License Act of 2000 requires timely disclosure of latent material adverse facts about the physical condition of the property that the licensee actually knows and that a reasonably diligent inspection could not find. Those two sentences are the whole structure, and everything below is the detail.

Gambino Realtors has been in business in Rockford since 1923, and disclosure is the part of agency law where a new agent's words matter most. This guide reads the statute section by section, then connects it to the separate seller disclosure law. If you are choosing where to start your career, our guide on

Yes, CAN-SPAM covers an agent's marketing email, and it has no exception for business-to-business messages. The Federal Trade Commission's compliance guide says the law "covers all commercial messages," and it sets out eight main requirements, from accurate header information to an opt-out you honor within 10 business days. Each separate email that breaks the law can carry a penalty of up to 53,088 dollars, according to the FTC's guide as edited in January 2024.

That is the short answer. The longer one matters if you are starting out and weighing how to choose your first brokerage, because an email list is often the first marketing tool a new agent builds. Gambino Realtors has been in business in Rockford since 1923, and this guide sticks to what the federal rules say, drawn from the FTC's own guide and the text of the statute and the FTC's rule. It is not...

Two sets of federal rules decide whether an agent may call or text a lead. The Federal Trade Commission's Telemarketing Sales Rule bars an outbound sales call to a number on the National Do Not Call Registry unless the seller holds the person's signed written agreement or has an established business relationship with that person. The Federal Communications Commission's rules add consent requirements for autodialed or prerecorded calls and for texts sent to wireless numbers.

If you are weighing offices, read how to choose your first brokerage next to this guide, because lead calling is one of the daily habits a new agent has to settle before the first week is over. Gambino Realtors has been in business since 1923 and is based in Rockford. This article walks through what the rule text says, in plain words, and it says where the rule text is silent. It is not...

The Illinois Real Estate License Act of 2000 is state law, and the Illinois Department of Financial and Professional Regulation (IDFPR) enforces it with fines of up to 25,000 dollars for each violation. The NAR Code of Ethics is a different kind of document. It belongs to a trade association, it has 17 Articles, and REALTORS voluntarily subscribe to it. A licensee can be bound by the Act alone, or by the Act and the Code together.

That difference decides who can complain, who hears the complaint, and what the outcome can be. If you are still weighing offices, read how to choose your first brokerage next to this guide and ask each office which memberships it expects and which rules it trains on.

This guide compares the 2026 NAR Code of Ethics and Standards of Practice with the Illinois Real Estate License Act and the Department's rule on unprofession...

Yes, an Illinois landlord with a single rental house has to follow a state security deposit statute. Since January 1, 2024, the Security Deposit Return Act applies to any lessor of residential real property with no minimum number of units, and it sets a 30-day deadline to send an itemized statement of damage and a 45-day deadline to return the full deposit when no statement goes out. The second statute, the Security Deposit Interest Act, is narrower. It reaches only lessors whose property has 25 or more units in a single building or in a complex of buildings on contiguous parcels.

If you own or are thinking about buying multi-family properties in Rockford, the first step in sorting out which act applies is a count of units. It explains what the text says and nothing more. It is not legal or tax advice, and an attorney or a tax professional confirms how a rule applies to a particular lease.

Which Landlords the R...
